1. Who we are and this agreement

The programme is operated by Boony Limited, trading as Boony Competitions, a company registered in England and Wales under company number 13296093 (“Boony”, “we”, “us”). Programme questions and notices can be sent to [email protected]. These terms, the commercial terms shown when you accept, the website Terms and Conditions and Privacy Policy form the affiliate agreement. If there is a conflict about affiliate activity, these programme terms take priority.

2. Appointment, eligibility and status

You are appointed as a non-exclusive affiliate. You must be at least 18, provide accurate account and payment information, and keep your account secure. You are responsible for deciding how, when and whether to promote us, subject to these rules. Nothing in this agreement creates employment, worker status, partnership, agency or authority to bind Boony; legal status will always depend on the facts and applicable law.

3. Advertising disclosure

Every promotion must be obviously identifiable as advertising from the first interaction. Use a prominent label such as “Ad” or “Affiliate” at or before the first mention of Boony Competitions. The disclosure must be clear on every relevant post, story, video, livestream, email and landing page; it must not be hidden behind “more”, only in a biography, among hashtags, or after a voucher code. Both you and Boony may be responsible for compliance.

4. Significant competition conditions

Each promotion must state material information needed for an informed decision, or present it prominently where space is genuinely limited. This includes, where relevant, eligibility and age limits, the closing date, the nature and number of prizes, entry price, material restrictions, how to participate, and the free-entry route. A link to full terms does not cure an otherwise misleading promotion. Never change a published closing date, imply guaranteed success, exaggerate a chance of winning, or describe a paid entry as free.

5. Responsible promotion and audiences

Do not target or appeal particularly to anyone under 18, anyone you know is self-excluded or suspended, or people whose circumstances make them vulnerable to financial harm. Do not encourage unaffordable, excessive or repeated spending, create false urgency, present participation as an investment or a solution to financial difficulty, or use pressure, shame or irresponsible claims. Follow any campaign-specific audience restrictions and takedown instruction immediately.

6. Channels, creative and electronic marketing

You may promote through channels you lawfully control unless we tell you otherwise. Use current, accurate and approved claims and creative. Do not send unsolicited email, SMS or direct-message marketing; buy or use third-party contact lists; impersonate Boony; register confusing domains or accounts; bid on Boony brand terms in paid search without written permission; publish unlawful or offensive content; use misleading voucher sites; or materially alter approved assets. You are responsible for complying with privacy and electronic-marketing law for your own audience.

7. Attribution and prohibited activity

Sales are attributed using the voucher code or tracking method shown in your account and Boony’s transaction records. Self-referrals, collusion, duplicate or fraudulent accounts, cookie stuffing, forced redirects, voucher misuse and purchases made on behalf of customers are prohibited. Do not use automated traffic, misleading links or any technique that interferes with genuine customer choice. We may investigate and withhold, reverse or refuse affected commission.

8. Commercial terms and commission

Your customer discount, alternative cash and website-credit commission rates, hold period, voucher and minimum cash payout are the commercial terms shown at acceptance and retained in your account. Commission is calculated on eligible net order value after discounts, refunds, cancellations and chargebacks. Cash and website credit are alternatives for the same sale and cannot both be claimed. A later refund, chargeback, fraud finding or calculation error may reduce unpaid commission or be set off against future sums where reasonably necessary; we will provide an explanation.

9. Settlements and payment information

Website credit is normally applied immediately after a valid request. Cash requests are reviewed and, once approved and complete payment information is available, we aim to process them within 10 working days. A request may be delayed while we investigate fraud, returns, compliance or inaccurate payment information. Never send bank details by ordinary email unless we specifically provide a secure process. The dashboard and settlement record show the amount and status of each request.

10. Tax and records

You are responsible for declaring and paying any tax, National Insurance, VAT or other liability arising from affiliate income and for obtaining your own tax advice. Tell us if you are VAT registered and provide a valid invoice where required. Keep records of income, expenses, promotions, approvals and disclosures for the period required by law; as a practical minimum, retain programme records for six years unless professional advice tells you otherwise.

11. Data protection, privacy and confidentiality

Use personal data only where you have a lawful basis and comply with UK data-protection and electronic-marketing law. Do not collect, copy, infer or disclose Boony customer information. Performance reporting is normally aggregated or order-referenced without customer identity. Keep non-public commercial, customer and security information confidential, including after this agreement ends. Our Privacy Policy explains how we use affiliate account, verification, attribution, compliance and payment data and how to exercise data rights.

12. Monitoring, approvals and cooperation

Keep reasonable evidence of promotions, disclosures and any creative approval and provide it promptly on request. Boony may monitor affiliate activity, require correction or removal, suspend codes or settlements during a proportionate investigation, and audit compliance. You must cooperate with reasonable requests. We may terminate relationships with affiliates or third parties who fail to meet legal, advertising or responsible-promotion standards.

13. Duration, suspension and termination

Either party may end the relationship by written notice. We may suspend or terminate immediately for fraud, misleading or irresponsible advertising, serious or repeated breach, failure to follow a takedown request, risk to customers or the brand, or legal and regulatory concerns. We will normally explain the decision unless doing so would compromise an investigation or legal duty. Valid commission earned before termination remains subject to the hold period, eligibility, reversals and set-off described above.

14. Changes, complaints, liability and law

We will version material changes and request fresh acceptance before they apply where appropriate. Important commercial terms will not be changed retrospectively for already-earned eligible commission. Contact [email protected] with a question, complaint or commission dispute; include the relevant date, post, order or settlement reference. Nothing excludes liability that cannot lawfully be excluded. To the extent permitted by law, Boony is not liable for indirect loss or expected future commission. This agreement is governed by the law of England and Wales and the courts of England and Wales have jurisdiction.

We record the terms version, content hash, time, IP address and browser details as evidence of your application and agreement.
